The Biden Administration is Planning For the End of Title 42

Since Title 42 went into effect, thousands of migrants have crossed the United States-Mexico border. Within weeks, the end of this policy will open the gates for more migrants to cross.

The Homeland Security Department is appealing the end of Title 42. The policy is expected to end on December 21 which will allow migrants to freely cross the United States - Mexican border. Currently, migrants in Mexico are aware of the end of the policy and patiently waiting for this day to come.

Title 42 was created under the Trump administration to limit immigrants from crossing the border during the COVID era.

U.S. District Judge Emmet Sullivan gave President Joe Biden five weeks before title 42 will end to allow the administration and agencies to prepare for this day. Border states in Texas and Arizona are also preparing.

According to the New York Post, the government attorneys wrote:

“This transition period is critical to ensuring that [the Department of Homeland Security] can continue to carry out its mission to secure the Nation’s borders and to conduct its border operations in an orderly fashion.”

At one point, thousands of migrants were crossing the Texas-Mexican border. It is likely those numbers will continue.

Who is pleased Title 42 will end

Though Article 42 will probably end this month, some think it is about time the policy ends.

ACLU attorney Lee Gelernt said:

“This is a huge victory and one that literally has life-and-death stakes. We have said all along that using Title 42 against asylum seekers was inhumane and driven purely by politics. Hopefully, this ruling will end this horrific policy once and for all.”

Senior attorney with the Beyond Borders Program at the Texas Civil Rights Project Karla Marisol Vargas said:

“Today’s decision is a win for the thousands of individuals hoping to exercise their right to safety. For the first time in years, people who are seeking protection at our borders, the majority of them Black, Indigenous, and Brown, will be allowed to exercise their right to seek safety and be processed under U.S immigration law, rather than being automatically sent back to danger. We expect that without Title 42 in place, the U.S. will have the ability and the capacity to process people — it’s a matter of will. TCRP has been fighting to end this policy for years in the courts, and at every turn the Biden administration has fought to keep it in place. The Biden administration should permanently end this cruel Trump-era policy that has stripped people of their due process rights. Ending Title 42 is the first step to restoring access to asylum and ensuring we welcome all people with dignity, respect, and compassion.”
